How Red Growth Capital LLC, doing business as Reddy Capital, collects, uses, shares and protects information about you and your business.

1. Who we are and what this policy covers

Red Growth Capital LLC, doing business as Reddy Capital ("Reddy Capital," "we," "us" or "our"), is based in Texas and provides revenue-based financing ("RBF") to businesses. This policy is provided to you as required by federal law. Safeguarding our business and commercial customers' information is very important and we take steps to protect such information.

This Privacy Policy explains how we handle personal information about the people we deal with: business owners, principals and authorized representatives who apply for or receive RBF; ISO and referral partners; and visitors to reddy.capital and our online application.

Our products are for business purposes only. We do not offer financing for personal, family or household use. If you sign an RBF agreement with us, that agreement may include additional terms about how information is used for your account.

2. Information we collect

Information you give us

  • Contact and identity details, such as your name, title, email address, phone numbers, home and business addresses, date of birth, and, where needed to verify identity or review a business owner, your Social Security number and a government-issued photo ID.
  • Business details, such as the legal and trade names of the business, Employer Identification Number, ownership percentages, time in business, industry and locations.
  • Financial details, such as the amount you are requesting and how you plan to use it, bank and card-processing statements, tax returns, existing financing and balances, and the bank account used for funding and payments.
  • Anything else you send us, including form entries, messages, support requests and documents.

Information from accounts you connect and from third parties

  • Bank account data you choose to share through Plaid, our bank-connection provider, such as balances, deposits and transaction history. The connection is read-only and your bank login credentials are handled by Plaid; they never reach our servers.
  • Credit and business reports, including consumer credit reports on business owners obtained with your authorization, and business credit reports.
  • Identity-verification and fraud-prevention results, and public records such as business registrations, liens, UCC filings and judgments.
  • If you apply through an ISO or referral partner, the application information that partner collected from you.

Information collected automatically

When you visit our website we collect technical information such as your IP address, browser and device type, pages viewed, the page that referred you and similar usage data, using cookies and the tools described in "Cookies and analytics" below.

Calls, texts and conversations

We keep recordings and transcripts of phone calls, and the content of text messages, emails and chat conversations with us, including conversations handled by an AI assistant.

3. How we use information

  • To review your application, verify your identity and the identity of the business, and decide whether and on what terms to offer RBF.
  • To prepare, fund and service your RBF agreement, including payments, renewals and, if necessary, collections.
  • To communicate with you about your application, account, payments and renewals, and, with any consent the law requires, about other offers.
  • To detect and prevent fraud, identity theft and other unlawful activity, and to protect our customers, partners and systems.
  • To meet our legal, regulatory, tax, audit and recordkeeping obligations, and to establish, exercise or defend legal claims.
  • To operate, secure and improve our website, application and services.

Funding decisions are made by our underwriting team. We do not use AI or other automated models to make final decisions about whether to fund a business.

4. How we share information

We do not sell personal information, and we do not share it with third parties for their own marketing. We share it only as described below.

  • Service providers that work on our behalf, such as cloud hosting, our CRM and communications platforms, bank-data connection (Plaid), identity verification and fraud prevention, payment and ACH processing, e-signature, website analytics, and our accountants, auditors and attorneys. They may use the information only to provide services to us.
  • Credit reporting agencies and business credit bureaus, to obtain the reports described above.
  • The ISO or referral partner who introduced you, if you applied through one, limited to the information needed to keep them updated on the status and outcome of your application.
  • Attorneys and collection service providers, where needed to enforce an RBF agreement.
  • Government agencies, courts, regulators and law enforcement, where required by law or legal process, or where needed to prevent fraud or protect rights, property or safety.
  • A buyer, successor or financing source in connection with a merger, acquisition, financing or sale of all or part of our business, subject to protections consistent with this policy.
  • Anyone else, with your consent or at your direction.

Mobile phone numbers and text-message consent are never shared with third parties for their marketing or promotional purposes.

5. Credit reports

Reviewing an application and making an offer does not require a hard credit inquiry. When you accept an offer, and from time to time while your account is open or when you apply for a renewal, we may obtain a consumer credit report on business owners, and business credit reports on the business, with your authorization.

If we decline or change an application based in whole or in part on information in a consumer credit report, we will tell you, including the name and contact details of the credit reporting agency that supplied the report and your right to obtain a free copy and dispute its accuracy.

We do not discriminate against any applicant on the basis of race, color, religion, national origin, sex, marital status, age, or any other characteristic protected by law.

6. Calls, texts, email and AI assistants

Call recording

Calls with Reddy Capital may be recorded and transcribed for quality, training, compliance and dispute resolution. We tell you at the start of the call; by continuing the call you agree to the recording.

Text messages

If you give us a mobile number and agree to receive texts, we may text you about your application, account, payments and renewals. We send marketing texts only with your prior express written consent, and consent to marketing texts is never a condition of receiving financing. Message frequency varies, and message and data rates may apply. Reply STOP to opt out at any time or HELP for help.

AI assistants

We may use AI assistants to answer questions, schedule calls and draft or send replies by chat, text, email or phone. Where the law requires, an AI assistant will identify itself as automated, and you can ask to speak with a member of our team at any time.

Email

You can unsubscribe from marketing emails using the link in any marketing email or by writing to privacy@reddy.capital. We will still send messages about your application or account, such as payment notices and required disclosures.

7. Cookies and analytics

Our website uses cookies and similar technologies to operate the site, remember your choices and understand how visitors use it. We use Google Analytics and Google Tag Manager to measure site traffic and performance. These tools collect information such as pages viewed, links clicked, device and browser type, and approximate location derived from your IP address, and Google processes it under its own privacy policy.

You can block or delete cookies in your browser settings, and you can opt out of Google Analytics with the Google Analytics opt-out add-on. We do not use advertising cookies or share information for targeted advertising, and we treat a Global Privacy Control signal from your browser as an opt-out. If we add advertising tools in the future, we will update this policy first.

8. How we protect information

We use administrative, technical and physical safeguards designed to protect personal information, including encryption in transit and at rest, access limited to people who need it, and read-only bank connections.

No method of transmission or storage is completely secure. If a security incident affects your personal information, we will notify you and the appropriate authorities as required by applicable law, including Texas law.

9. How long we keep information

We keep personal information for as long as we need it for the purposes described in this policy, including while your application or account is open, and afterward for as long as required or permitted by law for tax, accounting, regulatory, fraud-prevention and legal purposes. When information is no longer needed, we delete it or de-identify it.

10. Your privacy rights

Depending on where you live, including under the Texas Data Privacy and Security Act, you may have the right to:

  • Confirm whether we process your personal information and get access to it.
  • Correct inaccurate personal information.
  • Delete personal information, subject to legal retention requirements.
  • Receive a copy of your personal information in a portable format.
  • Opt out of the sale of personal information, targeted advertising and certain profiling. We do not sell personal information or use it for targeted advertising.

Some state privacy laws do not apply to information collected in a business or commercial context. Even where that is the case, we will consider and respond to reasonable requests from any individual.

To make a request, email privacy@reddy.capital or call 1-833-61-REDDY. We will verify your identity using information we already have and respond within 45 days, or tell you if we need up to 45 more days. You may use an authorized agent, and we will not treat you differently for exercising your rights.

If we decline your request, you may appeal by replying to our response with the word "Appeal." We will respond to appeals within 60 days. If your appeal is denied, you may contact the Texas Attorney General.

11. Children

Our website and services are intended for business owners and their representatives. They are not directed to anyone under 18, and we do not knowingly collect personal information from children.

12. Other websites and services

Our site links to services run by others, such as Plaid for bank connections and our online application. Those services have their own privacy policies, which we encourage you to read.

13. Changes to this policy

We may update this policy from time to time. When we do, we will post the new version on this page and update the date at the top. If we make material changes, we will provide additional notice where required.
